Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy applies to the collection, use, and sharing of "Consumer Health Data" by Geniusx.Net Corp. (“we”, “our”, “us”) as required by the Washington State My Health My Data Act (MHMDA), Nevada Senate Bill 370, and other applicable state consumer health privacy laws.

This is a standalone policy that strictly governs our practices regarding your sensitive health and reproductive information when you interact with our surrogacy programs, as well as our egg, sperm, and embryo donor programs.
1. Categories of Consumer Health Data We Collect
To provide our matching and coordination services, we may collect the following categories of Consumer Health Data:
        · Reproductive and Sexual Health Information: Information regarding pregnancies, menstrual cycles, fertility history, and reproductive outcomes.
        · Medical History and Conditions: Past and present physical or mental health conditions, diagnoses, treatments, or surgeries.
        · Genetic and Family History: Information regarding family medical history and genetic screening results.
        · Bodily Functions and Vital Signs: Basic physical characteristics (e.g., height, weight, BMI, blood type).
        · Inferences: Data derived or extrapolated from non-health information that could reasonably indicate your interest in reproductive services or fertility status.
2. Sources of Consumer Health Data
We collect Consumer Health Data from the following sources:
        · Directly from You: When you voluntarily fill out preliminary lead forms, detailed intake questionnaires, or communicate with our coordinators.
        · Inferred from Interactions: When you interact with our specific programmatic web pages or targeted forms.
3. Why We Collect and Use Consumer Health Data
We strictly limit the collection of Consumer Health Data to what is necessary to provide the services you have requested. The purposes include:
        · Eligibility Assessment: To conduct preliminary evaluations of your medical, psychological, and physical eligibility for our programs.
        · Program Matching: To securely facilitate matching between prospective donors/surrogates and intended parents, partner clinics, or partner agencies.
        · Coordination of Care: To securely transmit necessary profile data to licensed healthcare providers for medical screening.

Note on Consent: We obtain your affirmative, voluntary, opt-in consent before collecting your Consumer Health Data, which is completely separate and distinct from the consent obtained to share your data.
4. Sharing of Consumer Health Data
We DO NOT sell your Consumer Health Data. We do not share your health data with advertising platforms, social media networks (such as Meta/Facebook or TikTok), or data brokers.

With your separate and distinct affirmative consent, or when strictly necessary to fulfill your requested service, we may share all categories of Consumer Health Data listed in Section 1 with the following categories of third parties:
        · Partner Healthcare Providers (IVF Clinics): Medical professionals who conduct clinical and psychological evaluations.
        · Partner Agencies: Licensed surrogacy, egg, and sperm donor agencies that assist in the matching, screening, and coordination process.
        · Intended Parents: Select profile data is shared to facilitate the matching process. Highly sensitive medical records are only shared with your specific authorization.
        · Data Processors: Please note that under applicable laws, disclosing data to our service providers (such as secure cloud storage and customer relationship management platforms) who process data strictly on our behalf under written contracts is not considered sharing with a third party.

Specific Affiliates: We currently do not share your Consumer Health Data with any corporate affiliates, parents, or subsidiaries.
5. Third-Party Cross-Site Collection
In accordance with Nevada SB 370, we disclose that we do not permit third parties to collect Consumer Health Data about your online activities over time and across different internet websites or online services when you use our website.
6. Your Consumer Health Data Privacy Rights
Depending on your state of residence, you have specific rights:
        · Right to Access / Know: You have the right to confirm whether we are collecting, sharing, or selling your Consumer Health Data and to access such data. Upon request, we will provide a list of all specific third parties and affiliates with whom we have shared your data, including an active email address or online contact mechanism for each.
        · Right to Withdraw Consent: You have the right to withdraw your consent for our collection and sharing of your Consumer Health Data at any time.
        · Right to Delete: You have the right to request deletion of your Consumer Health Data. Upon authenticating your deletion request, we will delete your Consumer Health Data from our active records and network systems, and we will instruct all affiliates, processors, contractors, and other third parties to whom we have shared your data to delete it as well. Deletion from archived or backup systems may be delayed for up to six months (for Washington residents) or up to two years (for Nevada residents), as permitted by applicable state laws.
        · Right to Non-Discrimination: We will not discriminate against you (e.g., deny services or alter pricing) for exercising any of your consumer health data rights.
        · Review and Request Changes (Nevada): If you are a Nevada resident and wish to review or request changes to your Consumer Health Data, you may contact us using the methods provided in Section 8. We will review such requests on a case-by-case basis.
7. Data Security
We establish, implement, and maintain administrative, technical, and physical data security practices that satisfy a reasonable standard of care within our industry to protect the confidentiality, integrity, and accessibility of your Consumer Health Data, and in compliance with applicable Nevada data security requirements NRS 603A.

We will authenticate your request and respond within 45 days. For deletion requests from Nevada residents, we will respond within 30 days. We may extend these periods by an additional 45 days where reasonably necessary, provided we notify you within the initial response period.

        · Right to Appeal: If we deny your request, you may appeal our decision by replying directly to our denial email with the subject line Privacy Request Appeal. If your appeal is denied, you may file a complaint with your relevant state authority, such as the Washington State Attorney General (www.atg.wa.gov) or the Nevada Attorney General.
9. Changes to This Policy
We may update this Consumer Health Data Privacy Policy from time to time. If we make material changes to how we collect, use, or share your Consumer Health Data, we will notify you by prominently posting a notice of the changes on our homepage and updating the "Effective Date" at the top of this policy before the changes take effect.
